Auction Rules and Policy

  1. A bid entered into the auction system is a legal contract to purchase the item. Designation of the bid you have made by the auction official as the top bid is legal contract to purchase that auction item.
  2. Top bidders may pay for their items via credit card or ACH by signing into their bidder account and entering credit card or banking information on the auction website or Qgive app. If you have already entered your payment information, it will be charged at the close of the auction. Payment in full is mandatory before items will be distributed.
  3. All purchases are final and there will be no exchanges or refunds on items unless otherwise noted.
  4. We are a 501(c)3 charitable organization, Tax ID 94-2400210, and your payments are tax deductible as a charitable contribution, only to the extent provided by law.  Generally, you may deduct as a charitable contribution the amount you pay above the fair market value of the item.
  5. Reservations for trips and vacation accommodations must be mutually arranged with the donor unless otherwise noted.  
  6. All items will be mailed out to the winning bidder to the address on file within two weeks of the auction close date. Items will only be mailed after payment has been made. You may arrange to pick up your items from the Friends of the River office in Sacramento. Wine can not be mailed and must be picked up at the FOR office. Please pre-arrange a pick-up time with Amy Cottrell at amy@friendsoftheriver.org.
  7. Friends of the River has attempted to describe and catalog all items correctly, but all items are offered as is, and Friends of the River neither warrants nor represents, and in no event shall be responsible for the correctness of descriptions, authenticity, authorship, provenance or condition of the items.  No statement made in this catalog or made orally at the auction or elsewhere shall be deemed such a warranty for tax purposes or fair market value.  Items have not been appraised unless otherwise noted.
  8. Each person issued a bid number (bidder) assumes all risks and hazards related to the auction and items obtained at the auction.  Each bidder agrees to hold harmless from any liability arising there from Friends of the River, its elected and appointed officials, members and employees, the auctioneer(s), the auction company and its agents and employees, the event organizers, sponsors, and /or volunteers connected with the auction.
  9. In the auction catalog, Fair Market Value is an estimate of the retail value. Generally, we depend on the donor to give us a reasonable estimate of the item's retail value.
